Handling your personal data responsibly is a core concern for XpertCenter Ltd. This privacy policy describes how and why we process personal data.
In the following, “processing personal data” is understood to mean, for example, obtaining, saving, storing, using, changing, transmitting, archiving, deleting or destroying personal data.
“Personal data” (which also covers the term “person-related data”) is, in the following, understood to mean all information referring to an identified or identifiable person (e.g. name, date of birth, email address).
If you transmit personal data of other persons (e.g. family members or employees) to XpertCenter Ltd., please inform the person(s) concerned of this privacy policy regarding services, or send this policy to them. Please only transmit personal data of third parties if this has been permitted and the information provided is correct.
1 Scope of this privacy policy
This privacy policy applies to every processing of personal data in the course of activities specified below. The legal entity responsible for the data processing in accordance with data protection law is XpertCenter Ltd., Monbijoustrasse 5, 3011 Berne.
XpertCenter Ltd. is a Mobilière Group company.
Please note that additional specific privacy policies may apply. This is, for example, the case regarding the use of the website.
Data processing that XpertCenter Ltd. conducts on an assignment basis in accordance with data protection law is excluded from the scope of this privacy policy. For example, XpertCenter Ltd. processes personal data in connection with claims settlements on behalf of insurance companies. In such a context, the privacy policies of the party responsible provide information on the relevant data processing.

3 Providing data
The provision of certain personal data is essential for the fulfilment of the contractual services or legal obligations by XpertCenter Ltd.. Should you not be prepared to provide us with personal data, we may not be able to provide the contractually agreed services. You will find your rights specified in section 11.
4 Categories of personal data
XpertCenter Ltd. processes in particular the following categories of personal data that you or a third party reported to us, that we obtained from a publicly accessible source or that result from the processing of the contract:
- Information on the customer, e.g. family name, first name, nationality, home address, email address, property-related data, financial and payment collection data
- Information on third parties, such as data of a vehicle owner, garage owner, repair worker, former building owner, e.g. family name, first name, home address, email address, property-related data.
5 Purposes of processing
5.1 Overview
XpertCenter Ltd. processes your personal data under observation of the applicable legal regulations only for purposes explicitly stated to you or purposes obvious under the circumstances.

- Billing and settlement
- Administration of existing contracts
- Examination of creditworthiness (e.g. when preparing a contract conclusion)
- Answering and evaluation of inquiries and requests
- Exchange of data with service providers and third parties
- Exchanges with authorities
- Participation and collaboration in court procedures or procedures with authorities
- Ensuring observance of statutory and internal regulations
- Combating misconduct, misuse, violations and crimes
- Securing and protecting all data, confidential material and financial assets
- Maintaining the organisation of business operations
- Conducting and evaluating customer surveys (e.g. to elucidate the behaviour, activities, preferences and needs of customers)
- Internal training and security purposes (e.g. recording of telephone conversations)

- Optimisation and new development of products and processes
- Evaluation of data and maintaining statistics
5.3 Specific purposes related to individual services
In connection with the services listed below, your personal data are, in addition, processed for the stated purposes as well as for the fulfilment of the service contract.
- For the «Alles rund um Motorfahrzeuge» (everything related to motor vehicles) service, the data are processed for advisory purposes in connection with the purchase of a vehicle, incl. issuance of the associated documentation. Customers can choose between basic advice (one-time telephone conversation) and premium advice (personal onsite advisory session).
- For the «Oldtimer & Youngtimer» service, the data are processed in connection with the assessment of the vehicle’s condition, origin and value. The service variants are «Oldtimer Classic» (visual assessment incl. documentation) or «Oldtimer Top» (detailed technical assessment with extensive documentation).
- For the «XpertAcademy» service, the data are processed for the purpose of conducting courses (in particular course invitations, requests for course evaluations, sending of course documents) in the fields of general claim handling, motor vehicles, machines and boats, combating insurance fraud, recourse management, case management and corporate health management.
- For the «XpertHome» service, the data are processed in connection with the purchase or sale of real estate and advisory services relating to real estate (refurbishment, renovation, analysis of the property’s condition, etc.). Specialists from XpertCenter Ltd. answer questions regarding the structural condition, recommended renovation work, optimisation of energy supply and use, and the property’s current value. The advice is provided in writing in the form of a report.
6 Electronic communication
Please note that electronic communication (e.g. via email, text message, Messenger, social media) is, as a rule, not encrypted. Data may be lost or intercepted and manipulated by third parties. XpertCenter Ltd. takes appropriate technical and organisational security measures to prevent this from happening within the XpertCenter systems. Your end device (computer, smartphone) and the services used, however, are beyond the scope of XpertCenter’s security system. It is the internet user’s responsibility to obtain information on the necessary security precautions and to implement the appropriate safeguards (e.g. up-to-date virus protection). Insofar as you communicate with XpertCenter Ltd. via unsecured means of communication, you must be aware of the associated risks. In accordance with legal regulations, XpertCenter Ltd. refuses to accept any liability in this connection.
7 Data from third parties
Your personal data processed by XpertCenter Ltd. are primarily provided by yourself. However, personal data may be supplemented by or aligned with person-related or non-person-related information from public authorities, financial institutions, business and loan inquiry sites, etc. stemming from publicly accessible sources (e.g. the internet).
Reasons for this include, for example, the need to check the correctness of data to ensure the best-possible data quality, to check offers, to provide contractual services (e.g. appropriate advice in connection with the purchase of a vehicle), and to optimise processes in general. For such reasons, data in the categories specified in section 4 above may be obtained.
8 Data recipients
A recipient is understood to mean any person to whom personal data is transmitted or made accessible. The recipients are service providers who process the data on behalf of XpertCenter Ltd., for instance IT, vehicle or real estate specialists or architects. The service providers are contractually obliged to observe currently valid data protection law and to keep all information confidential. They may process the data only for the contractually specified purposes and not for purposes of their own.
Personal data are only transmitted to recipients abroad if these recipients are subject to adequate data protection law. If data are transmitted to a service provider in a country without adequate data protection legislation, adequate data protection is ensured by means of contractual guarantees or, in exceptional cases, by your personal approval. For this purpose, we, as a rule, use the standard contractual clauses issued or recognised by the European Commission and the Federal Data Protection and Information Commissioner (Eidgenössischer Datenschutz- und Öffentlichkeitsbeauftragter) (further information and a copy of these clauses can be found at www.edoeb.admin.ch/edoeb/de/home/datenschutz/handel-und-wirtschaft/uebermittlung-ins-ausland.html), provided the recipient is not already subject to a legally recognised body of laws and regulations to ensure data protection, and there is no exemption clause we can build on. Exceptions can, for example, be a legal procedure abroad, cases of overriding public interest, cases in which the processing of a contract requires such transmission of personal data, cases in which you have personally approved such a transmission, or if the data in question are publicly accessible and you have not objected to their use. XpertCenter Ltd. may call on the services of service providers in European and in other countries. Personal data may thus be processed worldwide. 9 Duration of storage
XpertCenter Ltd. processes your personal data for as long as this is necessary for the fulfilment of the purposes specified above. After that, your personal data are, as a rule, deleted or anonymised. Your personal data may, however, continue to be processed due to legal storage obligations or for the period in which claims against XpertCenter Ltd. may be filed. The duration of data storage is largely governed by statutory periods of limitation and the period in which claims against XpertCenter Ltd. can be filed.
10 Data security
XpertCenter Ltd. takes appropriate technical and organisational measures to protect your personal data against manipulation, loss, destruction or access by unauthorised persons. These measures are guided by international standards and are accordingly re-examined and, if necessary, adjusted on a regular basis.
11 Rights of the persons concerned
If your personal data are processed by XpertCenter Ltd., you may, in accordance with applicable data protection law, make use of the following rights at any time and, as a rule, free of charge:
11.1 Right of information
You have the right to require information on the personal data of yours that are processed by XpertCenter Ltd.. You can submit your request for information in writing, enclosing a copy of your ID card or passport, to the address stated under “Contact” (section 2).
11.2 Right of correction
XpertCenter Ltd. does its utmost to ensure that your data are correct and up to date. Should we nevertheless have incorrect personal data of yours saved, we will be glad to correct them at your request.
11.3 Right of objection
You have the right to object to the processing of your personal data that is not essential for the fulfilment of the contract, that we are not legally obliged to carry out, or that is carried out without overriding or justified interest on the part of XpertCenter Ltd., with immediate and lasting effect.
11.4 Right of deletion or limitation
You have the right of deletion of your personal data or limitation of their processing if the processing is not essential for the fulfilment of the contract, if the processing is not required by law (e.g. statutory storage requirement) or if the data are processed without justified interest on the part of XpertCenter Ltd..
11.5 Right of data transfer
In certain cases you have the right to have your personal data registered in a common electronic format, or to have them transferred and/or transmitted to a different person or entity.

The aforementioned companies are also referred to in the following as “XpertCenter”, “we” and “us”. XpertCenter is a Mobilière Group company (all companies of the Mobilière Group can be found at https://www.mobiliar.ch/gruppe).
These websites may contain links to other websites that this privacy policy does not cover. Please consult the applicable third-party privacy policies. XpertCenter has no influence on such data processing by third parties.

3. Provision of data
The provision of certain personal data is essential for fulfilment of the contractual services or statutory obligations by XpertCenter Ltd. We may therefore not be able to provide our contractually agreed services if you are not prepared to provide us with personal data. Please also take note of your rights as specified in section 16.
4. Data processing during use of our websites
Whenever you access the www.xpertcenter.ch and www.xperthome.ch websites, XpertCenter collects so-called log files. These are log data about use of the websites. The following data may be processed, for instance:
- IP address of visitor
- date and time of access to website
- volume of data transmitted including name of file etc.
- browser type, version and language
- operating system and version
- websites retrieved
- notification of successful retrieval
- URL of previously visited site (so-called referrer URL)
- information entered in entry fields
- For use of the customer portal and app: username (user ID)
- device details
- time spent on portal and app
- click data
- scrolling data
These data are processed for statistical purposes, for operating and enhancing the websites, for marketing purposes and thus in the legitimate interest of XpertCenter.
5. Basis for the processing of personal data
Your personal data may be processed on the basis of the following:
- initiation or performance of a contract,
- an applicable statutory requirement,
- consent granted by you or a person authorised by you, or
- an overriding or legitimate interest on the part of XpertCenter in processing the data, in particular in order to pursue the purposes outlined and their associated goals and to execute corresponding measures.
6. Data from third parties
The personal data processed by XpertCenter primarily come from you personally (e.g. when completing the form for initiating contact or registering for courses). They also include data about the use of its websites.
7. Newsletter and e-mail marketing
XpertCenter uses the e-mail/newsletter communication channel to send out offers customised for you and other relevant information. We also use e-mail notifications automatically sent to the recipient to confirm orders and dispatches. For all types of newsletter/e-mail, the personal data you provide (e.g. last name, first name, e-mail address) are used to address you personally.
When using e-mail, push notifications and other electronic channels, we may also process data about your response to communications (e.g. whether a newsletter/marketing e-mail is received and opened) in order to identify communications that are of interest to you and optimise our measures for you. In addition, use of an XpertCenter website may be analysed if visited via a link in an e-mail. We use this information to gauge the success of campaigns. These evaluations are carried out on an aggregate basis without any customisation.
Newsletters may be sent with your consent and under specific conditions based on a legitimate interest. Each newsletter contains the option of unsubscribing from future newsletters. To do so, please use the link contained in the respective newsletter.
8. XpertCenter webinars
We offer so-called webinars on specific topics. If you register for a webinar, we will process the data you enter on registration (first name, last name, e-mail address, meeting metadata etc.). We may conduct an evaluation of participation. The data provided upon registration are transmitted to XpertCenter in encrypted form. The services of a third party are generally used for this. XpertCenter has no influence on the processing of your personal data by such provider. Please take note of the provider’s own privacy policy prior to participation.
9. Profiling and automated individual decisions
Profiling refers to the automated processing of personal data in order to analyse or predict specific personal aspects or behaviour. For example, it can enable customers to be supported and advised more individually or offers to be better tailored to individual customer needs. Profiling can be deployed for marketing purposes in order only to direct advertising to those persons potentially interested in it.
“Automated individual decisions” are decisions taken on a fully automated basis, i.e. without any relevant human influence, and that have negative legal implications or other similarly negative effects for you. We generally do not execute any automated individual decisions. We will inform you separately if we ever deploy any automated individual decisions.
You will have the option in such a case of having this decision reviewed manually by an employee of XpertCenter. Further details can be found in section 16.6.
10. Cookies
Cookies are small files that are stored on your device (PC, smartphone etc.) when you retrieve a website. They provide information about the use of websites or apps.
The data of website visitors collected in this way are pseudonymised and not stored together with other personal data. Assignment of the data to a person is only possible if such person has unequivocally disclosed their identity for use of the websites (e.g. via login). In this case the information can be used for more targeted advertising.
The stored cookies can also be processed by other Mobilière Group companies and cooperating and advertising partners. However, they only receive data on the basis of an identification number, the so-called cookie ID. No personal data are transmitted.
10.1. Mandatory cookies
These cookies are required for the website to function and cannot be deactivated in your systems. In general, these cookies are only deployed in response to actions executed by you that correspond to a service request, such as configuring your privacy settings, logging in or completing forms. 12. Communication via the online contact form
When you communicate via the online contact form, we process the data conveyed to us from your communication in order to respond to your request and for any further communication with you. Your IP address and time details are also processed for this purpose. The information sent via the contact form is transmitted to XpertCenter in encrypted form.
13. Service providers
Service providers (e.g. for IT solutions) may under certain circumstances process personal data on behalf of XpertCenter. Service providers are contractually obliged to observe currently valid data protection law and to maintain secrecy and confidentiality. They may process the data only for predefined purposes and not for purposes of their own.
Personal data are only forwarded to recipients abroad if these recipients are subject to adequate data protection legislation. If data are transmitted to a service provider in a country without adequate data protection legislation, adequate data protection is ensured by means of contractual guarantees or, in exceptional cases, on the basis of your personal consent. Personal data may be passed on to service providers on the basis of a legitimate interest, to initiate and/or perform a contract or due to a statutory requirement. Consent is obtained for this where necessary.
14. Duration of storage
XpertCenter processes your personal data for as long as this is necessary for fulfilment of the purposes specified above. Thereafter your personal data are, as a rule, deleted or anonymised. However, your personal data may continue to be processed due to legal retention obligations or for the period in which claims against XpertCenter may be filed. The duration of data storage is largely governed by statutory periods of limitation and the period in which claims against XpertCenter can be filed.
15. Data security
XpertCenter takes appropriate technical and organisational measures to protect your personal data against manipulation, loss, destruction or access by unauthorised persons. These measures are governed by international standards and are accordingly reviewed and if necessary adjusted on a regular basis.
16. Rights of the data subjects
If your personal data are processed by XpertCenter, you may, in accordance with applicable data protection law, assert the following rights at any time and fundamentally free of charge:
16.1. Right of information
You have the right to receive information about your personal data processed by XpertCenter. You can submit your request for information in writing, enclosing a copy of your ID card or passport, to the address stated under “Contact”.
16.2. Right of correction
XpertCenter endeavours to ensure that your data are kept correct and up to date. Should we nevertheless have stored incorrect personal data about you, we will be happy to correct them at your request.
16.3. Right of objection
You have the right to object to any processing of your personal data that is not essential for fulfilment of the contract, that is not required by law or that is carried out without any overriding or legitimate interest on the part of XpertCenter, with immediate effect for the future.
16.4. Right of deletion or limitation
You have the right of deletion of your personal data or limitation of their processing if such processing is not essential for fulfilment of the contract, not required by law (e.g. statutory retention obligations) or if the data are processed without any legitimate interest on the part of XpertCenter.
16.5. Right of data transfer
In certain cases you have the right to request your personal data in a common electronic format or to have them transmitted and/or disclosed to a different person or entity (e.g. another insurance company).
16.6. Other rights

If we inform you about an automated decision (section 9), you have the right to state your position and to request a review of the decision by a natural person.
You also have the right to revoke consent granted to the extent that our processing is based on your consent. Revocation of consent granted only applies to further processing and only as long as we are unable to draw on any other legal basis to justify further processing of the data concerned.
17. Reservation regarding changes
This privacy policy is not part of the contract and may be adjusted in line with the latest legal provisions or the specific data processing concerned.
